After a four-hour ride on his motorcycle, one BMW owner realized that he had a problem. Namely, a problem with his erect penis, which after some waiting would not subside. Now while most of us would cheekily reply that such a state is the sign of a good motorcycle ride, this San Francisco Bay Area native is not laughing, and has filed suit in the Superior Court of San Francisco County (CGC-12-520316) against BMW Motorrad North American and Corbin-Pacific. Saying that the motorcycle and its dealer-installed custom motorcycle seat have caused priapism, the man is suing for lost wages, personal injury, medical expenses, product liability, and negligent infliction of emotional distress.

The complaint reads:

“Plaintiff was riding his 1993 BMW motorcycle equipped with a Corbin-Pacific seat. The ride lasted approximately two hours each way to plaintiff’s destination, after which plaintiff developed a severe case of priapism (a persistent, lasting erection). Plaintiff alleges that this condition was caused by the ridge-like seat on his motorcycle, negligently designed, manufactured and/or installed by defendants.

“Plaintiff now suffers from priapism (a long lasting erection), and has been experiencing continuing problems since his motorcycle ride. He is now unable to engage in sexual activity, which is causing him substantial emotional and mental anguish. Plaintiff is distraught and distressed because of this. Defendants, and each of them, are liable to plaintiff due [to] their negligent design, manufacture and/or installation of the seat on plaintiff’s motorcycle.”

Somewhere in BMW Motorrad HQ, a team of marketers are privately high-fiving themselves.

    If the priapism, which is actually a recognized disease, was caused by arterial damage from the seat, then BMW is in serious trouble. A couple of scans could confirm this. And then he could easily sue for a couple of million of bucks. And get them.

    The bike is a 1993 model with a replacement seat. BMW is in no way responsible for anything. You should really learn more about the law in the US.

  • Tom is absolutely correct. This is a liability of the seat mfg. BMW is out of the loop on this one. The question I would ask is how long has the guy had the seat and how many times has he ridden it and did this occur on each ride. I doubt there’s much of a case here.

    Well, its already happened. Corbin seats have raised their prices on the “Viagra” seat and I’ve already gotten 3 emails about a motorcycle seat that promises to please my woman.

    I don’t understand, how can having an erection keep you from having sex? He’s going to have a hard time (pun intended) in proving his wiener issue was due to the seat and the bike and not other medical issues or that new girl in the office.

    Ok it’s not a disease. Its a serious medical condition that in his case is possibly the result of vascular damage and which could further result in tissue damage. In other words, his manhood could rot off. But it’s not a disease, so BMW should be happy about that…?
    And since his seat was badly installed by his dealer (that’s what the story says), which I assume is a BMW dealership, I am pretty sure the BMW marketing team is not high-fiving themselves and sending good-luck telegrams to the dealer in question.
    Somehow “BMW’s destroy your manhood” doesn’t appeal that much to me.

    This is a perfect example of why the rest of the world thinks Americans are idiots and why the rest of the US thinks Californians are idiots.

    Here is a guy that no doubt has this problem and it can’t be his fault or just his poor luck. No, some evil corporation like BMW, Corbin seats, or the dealer has caused this. He thinks this in spite of the fact that I’ve never heard of another case in the many hundreds of thousands of corbin seats there are out there. I have a Corbin seat on my BMW and all they leave me with after a 4 hour ride is a smile on my face. Its not Corbin’s fault that a seat that works for many thousands of people around the planet didn’t work for him. Unless there is a gross flaw with his particular seat, then I don’t see where Corbin, BMW, or the dealer has done anything wrong. Even if the seat was done so poorly, why did he sit on it for 4 hours?

    Product liability laws are supposed to protect us from companies selling flawed products that they know are flawed and sell them anyway. That does not appear to be the situation here.

    This case reminds me of the whole “unintended acceleration” problems with Toyota. In that case, it turns out that a few people used 2 floor mats and that jammed the accelerator. The rest were either too stupid to tell one pedal from the other or trying to cash in this problem.

  • I have to agree with Dahveed on this. This suit is frivolous and hopefully a good judge will dismiss it.
    If the fella in question does indeed have a true medical problem then I hope he can get it resolved.

    Otherwise hopefully Corbin and other seat manufacturers can reproduce this seat and market it. I’m 57 and I’ll replace the Sargent seat on my R1150R with theirs. Hell, I’ll buy one for my Chevy truck!

    First, is it possible that this moron has been soooooo infatuated with BMW that when he finally was able to afford to buy a BMW motorcycle, that alone gave him the priapism???? Again, laughing my A$$ off here.

  • huummm…i will spread the word to those i know who suffer e.d. ….. suffering e.d.riders should switch to the bmw marquee and if not riders, should take the msf course and hit the classifieds and purchase a 1993 BMW motorcycle equipped with a Corbin-Pacific seat immediatly, as the plaintiff allows caused the reaction to his ride….

    After market seat that I am sure he asked to have put on. I can’t see how BMW is responsible. Improperly installed. If the seat did not fall off and is not loose, and made for that bike this is bull to. I have a Corbin seat and think it is the best made. I have done 735 miles in a day love it. This guy just got a bit to excited about the ride.. Never really liked the Power Ranger BMW riders anyway..

    Corbin stated today that they are temporarily suspending manufacture of any new seats to the general public. “We have been completely overwhelmed by middle aged Harley owners demanding BMW seats for their bikes and we are simply unable to fill their orders quickly enough to meet the demand”, a spokesman said.
